1. Acceptance of terms

These Terms of Service govern your access to and use of apexforged.app and any purchase of products from Apex Forged (“Apex Forged”, “we”, “us”). By browsing the site, creating an order or completing a purchase, you agree to be bound by these terms. If you do not agree, do not use the site or place an order.

You confirm that you are at least 18 years old and legally able to enter into a binding contract.

2. Description of products

Apex Forged designs and manufactures 3D-printed protective cases, multi-vial organizers, modular racks, travel systems and related accessories, together with labels, desiccant cartridges and carrying pouches. All products are storage and protection hardware.

We do not sell, supply, distribute, broker or facilitate the sale of peptides, research compounds, pharmaceuticals or any chemical or biological substance. No product listed on this site contains any such substance.

3. Research use only

All products are intended solely for the organization, protection and storage of materials in laboratory and research settings. Products are not medical devices, are supplied non-sterile, and are not cleared, approved or certified by any regulatory authority.

Products are not intended for diagnostic, therapeutic, clinical or veterinary use, and are not for human or animal consumption. Nothing on this site constitutes medical, clinical, scientific or regulatory advice, and we make no therapeutic claims of any kind.

You are solely responsible for determining that a product is suitable for your intended application and for complying with all laws, institutional policies and safety requirements that apply to the materials you store in it.

4. Accounts and information

Checkout can be completed without creating an account. Where an account or subscription is offered, you are responsible for the accuracy of the information you provide and for maintaining the confidentiality of any credentials.

You agree to provide current, complete and accurate order and contact information. We may cancel or refuse an order where information is inaccurate, incomplete or suspected to be fraudulent.

5. Orders, pricing and payment

• All prices are listed in United States dollars and exclude shipping and applicable taxes unless expressly stated.
• Placing an order is an offer to purchase. A contract is formed when we confirm dispatch of the order.
• We may correct pricing or description errors and cancel affected orders, refunding any amount already charged.
• Payment is processed by Stripe. By submitting payment details you authorize the charge of the full order total, including shipping and tax.
• Products are offered subject to availability. Limited editions are capped at the stated run size and are not restocked.

6. Shipping and delivery

In-stock orders are dispatched within 48 hours on business days. Delivery estimates are estimates only and are not guaranteed. Risk of loss passes to you upon delivery to the carrier.

For international orders, you are the importer of record and are responsible for all duties, taxes and customs charges, and for ensuring the products may lawfully be imported into your destination country.

7. Returns and refunds

Unused hardware in original packaging may be returned within 30 days of delivery following the process set out on our Shipping & Returns page. Return authorization must be obtained before shipping an item back. Return shipping is paid by the customer unless the item arrived damaged, defective or incorrect.

Custom, engraved or made-to-order units, opened desiccant cartridges and opened label sheets are not returnable unless defective. Refunds are issued to the original payment method within 5–10 business days of inspection.

8. Intellectual property

All product designs, 3D models, CAD geometry, photography, text, branding, the Apex Forged name and the “Forge Your Peak” mark are owned by Apex Forged and protected by intellectual property law.

Purchase of a product grants you ownership of the physical article only. It does not grant any licence to reproduce, reverse engineer, scan, 3D print, manufacture, distribute or create derivative works from our designs, nor to use our branding or imagery for commercial purposes.

9. Prohibited uses

• Using products for any human, animal, clinical, diagnostic or therapeutic purpose.
• Representing our products as medical devices, or making regulated claims in connection with them.
• Reverse engineering, scanning, copying or manufacturing reproductions of our designs.
• Reselling products with altered descriptions, altered disclaimers or misleading claims.
• Using the site to transmit malicious code, to attempt unauthorized access, to scrape content at scale or to interfere with site operation.
• Using products or the site in violation of any applicable law, export control or sanctions regime.

10. Disclaimer of warranties

Except for the express 12-month limited warranty against manufacturing and material defects described on our Shipping & Returns page, products and the site are provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that a product will preserve, stabilize or protect any material stored within it, or that the site will be uninterrupted or error free.

11. Limitation of liability

To the maximum extent permitted by law, Apex Forged and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, research materials, samples or business opportunity, arising out of or relating to the products or the site, whether based in contract, tort, strict liability or otherwise, even if advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to any product or order will not exceed the amount you actually paid for the product giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations, in which case the above applies to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend and hold harmless Apex Forged and its officers, employees and suppliers from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or related to your use of the products, your breach of these terms, your violation of any law, or any claim that materials you stored in our products caused harm.

13. Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. The courts located in Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these terms or any purchase, and you consent to that jurisdiction and venue.

Before commencing formal proceedings, you agree to contact us at support@apexforged.app so we can attempt to resolve the matter directly.

14. Changes to these terms

We may revise these terms at any time by posting an updated version on this page with a new effective date. The terms in force at the time you place an order govern that order. Continued use of the site after an update constitutes acceptance of the revised terms.

15. Severability and entire agreement

If any provision of these terms is found unenforceable, the remaining provisions remain in full effect. These terms, together with our Privacy Policy and Shipping & Returns policy, constitute the entire agreement between you and Apex Forged regarding the site and your purchases.
